I.Definitions

CGUV or Conditions: the general conditions of use and sale of the Site, in their version in force at the date of the Order;

Terms and Conditions: The general terms and conditions of use and sale of the Site, in the version in force on the date of the Order;

Customer: Any person placing an order for a Gift Certificate via the Website or booking an individual treatment or group class via the External Booking Module or the Website.

Personal data/Data: Any data within the meaning of Article 5(a) of the Federal Act on Data Protection ("FADP"; RS 235.1), i.e., any information relating to an identified or identifiable person;

Sensitive personal data: Any data within the meaning of Article 5(c) of the Federal Act on Data Protection ("FADP"; RS 235.1), in particular data relating to health.

In particular, when booking Services using the PERFACTIVE external booking module, the privacy policy of ELEGON Sàrl (https://perfactive.ch/confidentiality) is solely applicable.

EGNOKA may ask you to provide contact information through forms available on the Site. The contact information we may ask you to provide is as follows:

When you purchase a Gift Card through the Website, EGNOKA may process the following information in addition to your Contact Information:

  • Buyer's name
  • Buyer's first name
  • Buyer's email address
  • Buyer's phone number
  • Beneficiary's title
  • Beneficiary name
  • Beneficiary's first name
  • Comment for the beneficiary
  • Last four digits of credit card number

Data relating to the purchase of a Gift Certificate is used for the following purposes:

  • execute the command;
  • Contact you or send you information for any other reason EGNOKA deems useful;
  • meet legal or regulatory obligations.

When the recipient is not the person purchasing the Gift Certificate, the latter understands and accepts that the recipient's Personal Data entered on the Website is their sole responsibility.

C. Payment of benefits

When you purchase a Gift Certificate on the Website, you enter your payment details directly with the payment service provider, who is responsible for collecting payment on our behalf.

Payment is processed via STRIPE, our Payment Provider. We do not store any card details. Payment is made via STRIPE, our Payment Provider. By clicking on the "Order" button, you expressly authorize us to charge your credit card for the selected amount and any shipping costs. Credit card information is processed and stored by our Payment Provider. We do not process or store any credit card information. We only have access to the last four digits of your credit card number. The payment services that can be used for Orders on Our Site are provided by Our Payment Provider and are subject to the Payment Card Industry Data Security Standards (PCI DSS), which include online payment terms of service. I. Data Sharing

EGNOKA uses the services of the following subcontractors:

  • Aut O'Mattic A8C Ireland Ltd, based in Dublin (Ireland), operator of the WordPress solution, for the management of the Site's content;
  • Hartwig Consulting Sarl, headquartered in Chêne-Bourg (Switzerland), for the creation and maintenance of the Website;
  • Infomaniak Network SA, headquartered in Geneva (Switzerland), for hosting the Website and the Personal Data collected, as well as for the messaging service and sending emails to mailing lists;
  • Microsoft Ireland Operations Ltd, headquartered in Dublin, Ireland, operator of the Outlook solution for email services;
  • Proton AG, headquartered in Plan-les-Ouates (Switzerland), for the secure messaging service;
  • Elegon Sàrl, headquartered in Geneva (Switzerland), for the follow-up file of each person who has provided services at the Clinique Naturelle.

We take measures in line with market standards to protect Your Data from accidental loss and unauthorized access, use, alteration, and disclosure.

VII. User Rights

You have the right, at any time and without giving any reason, to :

  • ask what Personal Data concerning You is processed by EGNOKA;
  • receive a copy of Your Personal Data;
  • request the rectification of Your Personal Data;
  • revoke consent given for a particular Treatment(s) ;
  • request the deletion of all Personal Data concerning You (subject to Data that EGNOKA has an overriding interest in retaining).

Any dispute arising in connection with EGNOKA's Processing of Personal Data collected through the Site shall be subject to the exclusive jurisdiction of the ordinary courts of the Canton of Geneva, with recourse to the Federal Court being reserved.
